WHO IS THE “THIRD-PARTY RESPONSIBLE”
The Third-Party Responsible is the entity formally appointed by the building owner or property manager to operate, manage, maintain, and oversee the heating system, assuming all legal responsibilities established by current regulations.
This role is mainly governed by:
- Legislative Decree 192/2005
- Presidential Decree 74/2013
- Ministerial Decree 37/2008
The appointment must be made through a written agreement and can only be assigned to a company that meets the technical and professional requirements set out by law.
Entrusting a heating system to a Third-Party Responsible means transferring operational duties and legal accountability, ensuring compliant, safe, and continuous system management.
WHEN APPOINTMENT IS MANDATORY
The appointment of a Third-Party Responsible is mandatory when:
- the system’s thermal output exceeds 232 kW
In practice, however, it is strongly recommended for systems above 35 kW, especially in complex buildings such as:
- nursing homes (RSA) and healthcare facilities
- public buildings
- apartment buildings with complex central heating plants
- industrial and tertiary-sector facilities
For systems with an output exceeding 350 kW, additional requirements apply, including:
- ISO 9001 certification or SOA qualification
- specific operating licenses, FGAS certifications, and FER training, depending on the installed technologies
Non-compliant management may result in administrative penalties, civil liability, and safety risks for occupants.
OPERATIONAL DUTIES OF THE THIRD-PARTY RESPONSIBLE
The Third-Party Responsible is not merely a formal figure, but a hands-on and strategic role operating on multiple levels.
Daily system management
- Planning and control of system operation
- Monitoring temperatures, pressures, efficiency, and safety parameters
Ordinary and extraordinary maintenance
- Scheduling periodic maintenance activities

- Inspection of boilers, pumps, control systems, and metering devices
Energy monitoring and efficiency improvement
- Consumption analysis
- Optimization of system settings
- Reduction of energy waste
- Enhancement of overall system performance
Documentation and regulatory compliance
- Compilation and updating of the System Logbook
- Data transmission to regional registries (e.g. CURIT)
- Preparation of documentation for inspections and audits
Safety and service continuity
- Prevention of system downtime
- Protection of users and facilities
- Ongoing compliance with current regulations
